Auction Format: The auction is conducted online only through www.firesaleauction.com, with items divided into lots. The written description of each lot is exact, and what's described is what you will receive.
Malfunction: In case of computer hardware or software malfunction, the auctioneer reserves the right to remedy the situation, including canceling bids or reopening the auction.
Bidder/Purchaser Obligations:
- Purchases cannot be retracted; all sales are final.
- Lots are sold "Where-Is, As-Is" without a guarantee or warranty.
- Bidders should inspect and research lots independently.
- Bidders should not solely rely on the auction catalog for bidding.
- Payment and removal of purchases must occur within specified time frames.
- Bidders are responsible and liable for their purchases.
Consignor/Seller Obligations: Consignors are not allowed to bid on their lots or direct others to bid on their behalf.
Reserve: The auctioneer may set minimum bids on lots and can bid on behalf of the seller for lots with reserves.
Registration: Bidders must register on the bidding platform (Firesaleauction.com) and accept the terms and conditions during the sign-up process.
Buyer's Premium: A buyer's premium of fifteen percent (15%) will be added to each purchase.
Titled Vehicles: Tennessee State residents must pay sales tax and title/license fees on titled vehicles. Out-of-state residents may be exempt from sales tax.
Payment: Various payment methods are accepted, including credit cards, cashier checks, wire transfers, and cash. Identification verification may be required.
Chargebacks: Buyers agree not to initiate chargebacks to their credit cards, waiving any chargeback rights.
Possession and Removal: Possession of purchases occurs after full payment, and removal must be completed within the specified period.
Property Damage and Personal Injury: Buyers are responsible for any damage or injury caused during removal, loading, or transport of their purchases.
Proof of Insurance: Insurance may be required for dismantling or changing purchases on the premises.
Shipping: Limited shipping options are available, and shipping arrangements must be coordinated with the auctioneer.
Recourse for Non-Payment and Non-Removal: The auctioneer has various actions it can take if a buyer fails to pay or remove their purchases, including charging the credit card, arranging removal and storage, reselling the purchases, and assessing interest and legal expenses.
Lot Representation in Auction Catalog: The auction catalog may not provide all details, and buyers are responsible for inspecting lots.
Lot Guarantee and Warranty: Only lots explicitly labeled with "guarantee" or "warranty" include such assurances. All others are sold as-is.
Safety Risk: Buyers should be aware of safety hazards both on the premises and with the items being auctioned.
Bidder/Purchaser Acceptance of Liability: Buyers accept responsibility for any risks or defects associated with their purchases.
Indemnification: Buyers agree to indemnify and hold the auctioneer harmless from any liability arising from their purchases.
Governing Law and Jurisdiction: The agreement is governed by the laws of the State of Tennessee, and any legal disputes will be resolved in the courts of Tennessee.
Severability: If any part of the agreement is found invalid, it won't affect the validity of the rest of the agreement.
No Waivers: Auctioneers' failure to exercise any right or remedy does not waive their rights in the future.
Electronic Acceptance: Acceptance of the agreement electronically has the same legal effect as a signed hard copy.
